The following penalty against the #11 Late Model Car and Driver has been imposed by Colorado National Speedway.

Actions detrimental to the sport of Auto Racing. Car was found with tires that had been treated with foreign chemical compositions commonly known to be used in solutions for enhancing the performance of tires. Foreign chemicals were found in extensive laboratory testing using Dynamic Headspace Concentration, Gas Chromatography and Mass Spectroscopy methods by a certified laboratory.

The Car and Driver are suspended for the July 25th race. The driver will forfeit all points currently accrued for the year and fined a total of $1,000.00, which constitutes monies earned for the July 11th race event. This fine must be paid before the driver or car will be allowed to return to competition at Colorado National Speedway. This penalty assessment is not appealable.

The ownership, management and personnel of Colorado National Speedway makes no specific accusations or assumptions against any one person or persons that may be responsible for this infraction within the #11 Late Model team. Further, Colorado National Speedway does state with factual certainty that the tire submitted to CNS personnel for inspection on July 11th, which was utilized in competition, had been treated with a substance known to be a performance enhancing agent prior to this competition. Colorado National Speedway and the NASCAR Weekly Racing Series ownership and management firmly stand behind the findings of the certified laboratory used to perform this analysis and the processes and procedures used to collect and deliver the tested samples to this facility. This type of rules violation will not be tolerated at CNS and future testing will continue to be performed to ensure to the best of our ability that all competitors are given an opportunity to compete on a level playing field within the confines of the 2009 CNS rulebook.
